If you’re planning to sell your home on the Costa Blanca, there’s great news - the Valencian Community has officially abolished the “tanteo y retracto” requirement for most private property sales. In simple terms, that means no more administrative delays, no more waiting for government approval, and much smoother transactions for both sellers and buyers.

What was Tanteo y Retracto?

Until recently, the Valencian Regional Government had the right to step in and purchase certain properties under the same conditions as the buyer.

  • Tanteo was the right of first refusal — the government could buy a property before the private sale went through.
  • Retracto allowed them to buy it back even after the sale, by matching the agreed price.

This system aimed to control speculation and protect affordable housing, but in practice, it often created serious delays. Sellers had to notify the administration of the sale and then wait up to 60 days for an answer before going to the notary.

What’s Changed

With the approval of Law 5/2025, the Valencian Community has officially cancelled these rights for most residential properties. From now on, if your home is not classified as a subsidized or protected property (VPO), you no longer have to notify the Generalitat before selling.

In other words, for the vast majority of homes in areas like Altea, Calpe, Benidorm, Jávea, or Finestrat, you can now sell directly without the long administrative process. The change took effect on June 1, 2025 - a major step toward modernizing the Costa Blanca real estate market.

For homeowners, this means faster closings, fewer complications, and less stress at the notary. You can negotiate freely, sign confidently, and complete your sale without fear of late administrative intervention.
